Q. I'm a recording artist and my royalties are based on a recommended retail price, but there's no such thing any more is there?

A. Only really in the USA and Japan. The chances are that your record company "uplifts" their dealer price to arrive a deemed retail price for making the royalty calculation. Whether or not this uplift is sufficient or excessive is another argument.

Q. I've never really thought about checking my royalties. How far back can I go?

A. It depends on what your agreement says, but three years is typical. If you have a good relationship with your licensee (or it is found that they have acted fraudulently), then you can possibly go back further. We recommend that you reserve your right to audit your royalties on a regular basis. Again, even if you do not decide to proceed, the option remains available.
